OFFICIAL RULES

Nokia Products “Twitter” Contest

1. NO PURCHASE NECESSARY.  PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.

2. ELIGIBILITY:  The Nokia “Twitter” Contest (the “Contest”), brought to you by Nokia Products Limited (“Sponsor”), is governed by these “Official Rules”. The contest is open only to legal residents in their province or territory of residence – excluding the province of Quebec – that have reached the age of majority in their province or territory of residence at the time of entry.  Void where prohibited.  Sponsor reserves the right, at any time, to verify eligibility requirements, in any manner it deems appropriate.  Employees and directors of Sponsor, its parent, subsidiary, and affiliated companies, licensees, advertising, promotion or production agencies and provider companies (and their immediate family members and individuals residing in their same household) are not eligible.  All entries become the exclusive property of Sponsor. There is a limit of one entry per person and per Twitter address. For the purpose of this contest “immediate family members” includes parents, siblings, children and grandparents.

3. THE CONTEST PERIOD: The Contest begins at 12 a.m. P.S.T. on January 25, 2012 and concludes at 6:00 p.m. P.S.T. January 28, 2012 (the “Contest Closing Date”).  The Sponsor’s computer is the official time-keeping device for this Contest.  All Twitter entries must be received and recorded by Sponsor’s computer during the Contest Period.

4. TO ENTER: there is one (1) way to enter – send a Tweet with an image of your favorite snow related moment (snow day) and the hashtag #nokiaxburton before the Contest Closing Date.

All personal information obtained for this Contest will be used only for the purposes of conducting the contest. Entries that are incomplete, late, delayed, misdirected, altered, irregular, have been submitted through illicit means, or do not conform to or satisfy any conditions of these official Contest rules and regulations shall (will) be disqualified.

5. PRIZES:

FIRST PLACE: There are Five (5) Prizes available to be won. Each of these Prizes consists of two (2) VIP tickets and lift passes to the Burton Canadian Open 2012 to be held at Calgary, Alberta (http://www.opensnowboarding.com/Home.aspx?openid=CNO) January 30 – February 5, 2012.

All other expenses not expressly specified as being included in the Grand Prize (including, but not limited to, applicable taxes, gratuities, transportation between the winner’s home and venue, meals, or expenses or any other costs not specifically listed above as being included in the prize package) are the responsibility of the winner and his/her guest.

The approximate retail value of each of these prizes is $500  

SECOND PRIZE: There are Five (5) Prizes available to be won. Each of these Prizes consists of one (1) Nokia Lumia 710 handset.

The approximate retail value of each of these prizes is $350.00

Prizes may not be exchanged in whole or in part for cash or other substitutes, are non-transferable, non-refundable, non-saleable and must be accepted as awarded, except that the Contest Sponsor reserves the right at its sole discretion to substitute a prize for a prize of equal or greater value in the event that the prize or any component of the prize becomes unavailable.

6. DRAWING: A Random Draw for all 10 prizes will be conducted by the independent judging organization in San Francisco, Ca. on or about 12:00 p.m. P.S.T. January 29, 2012, from all eligible entries received by the Contest Closing Date. The odds of being selected depend on the total number of eligible entries received by the Contest Closing Date

Selected entrants will be contacted on Twitter by a response to the Tweet they submitted. This response will advise that their name has been selected as a possible winner in this contest and will direct them to email a @next15.com email account in order to complete the necessary contest release forms.

  

The selected entrants for the First Prizes will be contacted within one (1) hour of the draw date and time. They will be given a time deadline within which they must respond to the email address provided. If these selected entrants do not respond within the designated timeline, they will be disqualified and a new random draw from the remaining eligible entries will be conducted to select another entrant and the process noted above will be repeated until a selected entrant is contacted or there are no more eligible entries, whichever comes first.

Selected entrants for the Second Prizes will be contacted within three (3) business days of the draw date. If these selected entrants cannot be contacted within three (3) business days, they will be disqualified and a new random draw from the remaining eligible entries will be conducted to select another entrant and the process noted above will be repeated until a selected entrant is contacted or there are no more eligible entries, whichever comes first.

Before being declared a winner, the selected entrants must first sign a Declaration and Release Form (the “Release Form”) confirming compliance with these official contest rules and regulations, acceptance of the prize as awarded without substitution, and releasing the Contest Sponsor, affiliated and related companies, advertising and promotional agencies, the independent contest judging organization and their respective shareholders, directors, officers, employees, agents, dealers, representatives, successors and assigns (collectively, the “Releasees”) from any liability in connection with the prize or this contest as well as they must correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question.  This release and correctly answered skill-testing question must be completed and returned to NokiaxBurton@next15.com within one (1) business day (applicable to the selected entrants for First Prizes) and three (3) business days (for the Second Prizes) of notification.

Failure to answer the mathematical skill-testing question correctly or failure to return the Release Form within the time period indicated on the Release Form will cause the prize to be forfeited and a new random draw from the remaining eligible entries will be conducted to select another entrant and the process noted above will be repeated until a winner is declared or there are no more eligible entries, whichever comes first. 

7. PRIZE DELIVERY:

FIRST PRIZES: The confirmed winners of the First prizes will be awarded their prize at the Burton Canadian Open 2012 at Calgary, Alberta at 4:00 p.m. on January 30, 2012. In their confirmation notice these winners will be advised of a precise onsite location to be present at and will be required to present photo ID which matches the information that they will be required to provide on the contest release form.

SECOND PRIZES:  The confirmed winners of the Second prizes will receive their prizes by mail to the address supplied on their contest release form within two weeks of submitting their completed release form.

 

8. CONDITIONS OF PARTICIPATION: By entering this contest, entrants accept and agree (a) to abide by the official contest rules and regulations and the decisions of the independent contest judging organization with respect to all aspects of the contest, which are final, binding and conclusive on all matters relative to this contest; and (b) that the Releasees will have no liability whatsoever for, are released and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this promotion or in promotion-related activities.

By entering this contest, the prize winner authorizes the Contest Sponsor, and their respective representatives to use in any related publicity, if required, his/her name, photograph, image, any statements they may make regarding the prize, place of residence and/or voice for advertising purposes worldwide and in any form of media including the Internet, without any form of compensation and without limitation or further notification. 

In the event it is determined that an entrant has entered in a fashion not sanctioned by these official contest rules and regulations, the entrant will be disqualified and all of the entries submitted by the entrant will be disqualified. Entries are subject to verification by the independent contest judging organization.

The Releasees assume no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the Twitter social media application during the contest period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received by the Contest Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from any material in the Contest. Any attempt to deliberately damage or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.   

The Contest Sponsor, (or the independent contest judging organization) reserve the right, at their sole discretion, to change the terms of, void any entry and/or cancel, suspend or modify this contest in whole or in part without notice or liability if it determines that the contest is not capable of running as planned or there is something that in their opinion affects the administration, security, fairness, integrity or proper conduct of the contest.

Any person entering this contest or trying to do so by any means which go against the intention of these official contest rules and regulations and which would be unfair to the other participants will be automatically disqualified and the Contest Sponsor reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

No correspondence will be entered into except with the selected entrant.

 

9. GOVERNING LAW & ARBITRATION: This Contest is subject to all applicable federal, provincial and municipal laws and is void where prohibited. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than the administration of the Contest or the determination of winners, shall be resolved individually, without resort to any form of class action, and exclusively by the Courts of Ontario, Canada; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario.
